These General Terms and Conditions of Sale govern the purchase of products made remotely via the web on the site https://spaggiarigomma.it sold directly by SPAGGIARI INDUSTRIA GOMMA SRL © 2025, Spaggiari Gomma, VAT No. 00924770357 – Via G. Carboni 90 – 42045 Luzzara (RE) – Tel: 0522 825808 – info@spaggiarigomma.it (“SPAGGIARI GOMMA SRL”).

SPAGGIARI INDUSTRIA GOMMA SRL, located at Via G. Carboni 90 – 42045 Luzzara (RE), markets and partly produces the products shown on the Website.

ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

The present Terms and Conditions of Sale must be examined and accepted online by the Customers of the site https://spaggiarigomma.it prior to the confirmation of the purchase. The order therefore implies full knowledge and complete acceptance of the Terms and Conditions of Sale. Once the online purchasing procedure has been completed, the Customer undertakes to print and keep the present Terms and Conditions of Sale, which have already been viewed and accepted during the purchase process.

SPAGGIARI INDUSTRIA GOMMA SRL reserves the right at any time to modify these Terms and Conditions of Sale by publishing a new version on this website. The applicable sale conditions are those published on the site at the time the order is placed, as examined and accepted by the Customer.

WARRANTY

SPAGGIARI INDUSTRIA GOMMA SRL declares that the products to be delivered are in conformity with those shown and described on the online site and that the product images are to be considered illustrative and not binding.

Any evident defects must be reported by the Customer in accordance with the provisions of Legislative Decree no. 206 of 2005, art. 132.

Products purchased on the site https://spaggiarigomma.it are subject to the discipline, insofar as applicable, of Legislative Decree 206/2005 on consumer protection and, where not provided therein, to the specific provisions provided in the Italian Civil Code.

With the exception of the replacement of defective and non-conforming products, SPAGGIARI GOMMA SRL assumes no liability for any direct or indirect damages that might derive from the use, even improper, of the product by the recipient.

The warranty is personal and will therefore apply only to the original purchaser. Any product defect must be notified in writing by the Customer and documented with corresponding photographic material within the legal deadline at the time of the product’s return shipment, which must be previously authorized by SPAGGIARI GOMMA SRL.

SPAGGIARI GOMMA SRL reserves the possibility to verify the actual existence of the defect reported by the Customer, who then has the discretion to choose among the compensation methods indicated in the return conditions. The request will be processed only if the returned package includes the following documents: order number and date, detailed description of the detected defect, and the product in its original packaging.

Return shipping costs are borne by the Customer.

PURCHASE PROCEDURES

Purchases of the products, available online and described in the respective detailed listings, are made by the Customer at the indicated price, increased by any applicable shipping charges, as specified below. The Products are depicted and displayed on the Site in an accurate manner corresponding to their actual characteristics. In any case, SPAGGIARI GOMMA SRL cannot guarantee the exact correspondence to reality regarding the images and colors as they appear on the Customer’s monitor, should any discrepancies depend on the monitor settings. Before the order confirmation, the Customer will receive a summary showing the unit cost of each chosen product, the total cost in the case of purchasing multiple products, and the shipping charges. Upon order confirmation, the Customer will receive an email containing the order details.

 

PRICES

All prices listed on the website are VAT inclusive. The prices applicable for the products ordered by the Customer are those shown on the site on the date the order is transmitted. Prices may be modified at any time without notice, including for any promotions. However, prices do not include shipping costs, which will be invoiced based on the shipping rates indicated on the site on the date the order is transmitted and may be modified at any time without notice. Prices are expressed in Euros.

 

INVOICING

In the case of an invoice request, the Customer must send a communication after the purchase to the email address info@spaggiarigomma.it, specifying the following details:

  • Company name, VAT number, SDI, and invoicing details;
  • Order number and order date.

Please note that, for organizational reasons, invoice requests are not accepted when the payment method is cash on delivery and requests submitted more than 24 hours after the purchase will not be processed.

ORDER RECEIPT

https://spaggiarigomma.it is an e-commerce platform offering the purchase of rubber products and accessories as well as products made of other plastics. The purchase of the products, as illustrated and described online in the corresponding descriptive sheets, is made by the Customer at the price indicated, to be confirmed at the time of sending out the order confirmation, in addition to the shipping charges as specified below and in any case visible at the time of purchase.

Before confirming the purchase, a summary will be provided to the Customer detailing the unit cost of each selected product, the total cost in the event of purchasing multiple products, and the related shipping charges. Upon confirming the purchase, and upon completion of the transaction, the Customer will receive an email containing the Date and the Total Amount of their order (for payments made by Credit Card).

 

DELIVERY OF GOODS AND SHIPPING COSTS

All executed orders will be delivered to the shipping address specified by you at the time of placing the order, which may be your home or your workplace. To ensure that the delivery is successful, it is your responsibility to verify that the address is correct, and to provide a telephone number and email address along with clear instructions regarding the doorbell/intercom corresponding to the name provided for receiving the purchased goods.

Should there be any issues with the processing or delivery of the order, it is important that you can be reached to agree on any necessary changes.

In the days following the order, please check your email as we might send communications related to the processing of your order.

Orders will be processed within 3-5 working days from the definitive acceptance of the order, which is considered confirmed only upon the receipt of your payment on our bank account.

It is your responsibility to verify the quantity and condition of the merchandise at the time of delivery.

All shipments are at the risk and peril of the buyer: SPAGGIARI GOMMA SRL assumes no liability for any risks deriving from transportation and/or delays in delivery.

Shipping costs applied to each order vary based on the products chosen by the Customer and the destination of the goods.

For the Minor Islands and Free Zones, delivery times may be longer and shipping costs different, which will be communicated via email.

PAYMENT METHODS

Credit Cards: It is possible to make purchases using Visa, Mastercard, American Express, and Maestro credit cards.

 

RIGHT OF RETURN

In the event that the Customer is not satisfied with the purchased items, they have the right to return part or all of the goods belonging to an order without any penalty. The Customer can exercise the right of return within 15 working days from the date of delivery of the purchased products. The request must be sent via email to info@spaggiarigomma.it and must specify the order number, the item(s) to be returned, the reason for the return, and the contact details.

SPAGGIARI GOMMA SRL will respond via email granting authorization to return the goods. The shipment of the items to be returned can be carried out by any means chosen by the Customer; however, it is advisable to use a traceable shipment method since, until proof of receipt at our warehouse is obtained, the shipment is entirely the Customer’s responsibility. Nevertheless, SPAGGIARI GOMMA SRL will not accept returns sent under “cash on delivery” terms or via assigned port. The shipping costs will therefore be borne by the Customer.

Once the returned products are received, SPAGGIARI GOMMA SRL reserves the right to verify the integrity of the goods, ensuring that the returned products are in the same condition as when they were delivered. This verification may take up to 5 working days. Only after confirming the condition of the returned items will SPAGGIARI GOMMA SRL proceed with the refund within 14 days from the receipt of the returned merchandise.

Attention: The following items will NOT be accepted for exchange:

  • Products without the original packaging or with opened packaging;
  • Used products;
  • Products damaged due to improper handling by the Customer;
  • Packages returned under cash on delivery or via assigned port.

Additionally, affixing labels or adhesive tapes directly to the original packaging of the product must be avoided in all cases, under penalty of the return being refused.

 

REFUNDS

The Customer shall be entitled to a refund of the price paid for a product if they are not satisfied with the purchase. Shipping costs remain the responsibility of the Customer.

Refunds will be made using the following methods:

CREDIT CARD: For orders paid by credit card, the amount will be reversed from our systems and made available again on the Customer’s credit card statement according to the timing provided by the issuing bank (generally the following month).

FORCE MAJEURE

SPAGGIARI GOMMA SRL will make every effort to fulfill its obligations. However, SPAGGIARI GOMMA SRL cannot be held liable for delays or non-delivery caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural disasters, and any other event that makes production, transportation, or delivery of the products impracticable.

SPAGGIARI GOMMA SRL is not responsible for the actions of the courier regarding delays or non-delivery. For further information, please contact the courier directly.

 

EXEMPTION OF LIABILITY CLAUSE

The pages on this website are published by SPAGGIARI GOMMA SRL.

It is requested to read this disclaimer carefully, as the use of the website by the User implies acceptance of all the clauses contained herein.

SPAGGIARI GOMMA SRL reserves the right to make changes to the disclaimer published on this page at any time. The User is required to check the disclaimer and read its contents at each access to the website, since the use of the website constitutes acceptance of the disclaimer.
